If he thought he was not the legit owner he could have sent in a ticket and it would have been solved there w/o this flame war.

He can get his account back if he has oringinal email, IP, or purchase history.

Imo if he can show he even bought something on the acc a long time ago and shows his AP and old password he would get the acc back probably. It wouldn't get banned for "selling" if he can prove he didn't sell it or give enough doubt.
